A CHARTER ORDINANCE EXEMPTING THE CITY FROM THE PROVISIONS OF K.S.A. 12-744 RELATIVE TO RESIDENCE REQUIREMENTS OF PLANNING COMMISSION MEMBERS AND PROVIDING A SUBSTITUTE PROVISION ON THE SUBJECT OF RESIDENCE REQUIREMENTS FOR OVERBROOK CITY PLANNING COMMISSION MEMBERS AND AMENDING ORDINANCE NO. 241, SECTION 1.
BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF OVERBROOK, KANSAS:
Section 1. The City of Overbrook, Kansas under the authority of Article 12, Section 5, of the Constitution of the State of Kansas elects to and does hereby exempt itself from and make inapplicable to it, the provisions of K.S.A. 12-1222 relative to residence requirements for library board members, being part of an enactment applicable to such city, but not applicable uniformly to all cities and further provides for a substitute provision on the subject of residence requirements for board members for the Overbrook City Planning Commission.
Section 2. Ordinance 241, Section 1, is hereby amended to provide that at least three (3) members appointed to the Overbrook City Planning Commission shall be residents of the City of Overbrook with all members appointed to the Overbrook City Planning Commission being Osage County residents whose permanent home address is within 10 miles of the city limits.
